Agent subscription terms and conditions

These terms apply to real-estate agents and agencies who pay for a listing subscription on marsdenparkhomes.com.au ("Site"), operated by Marsden Park Homes Pty Ltd (ABN TBC) ("we", "us", "our").

These terms are in addition to the general terms and conditions that apply to all visitors. If there is any conflict between the two, these agent terms prevail to the extent of the inconsistency for matters concerning your subscription and listings.


1. Eligibility

To create an agent account you must:

  • Be at least 18 years old
  • Hold a current NSW real-estate licence (Real Estate Agent, Stock & Station Agent, or Assistant Agent) in your own name or be employed by a licensed agency
  • Have a valid Australian Business Number (ABN) for yourself or the agency
  • Be authorised to list each property you submit

You agree to provide accurate and current eligibility information and to update it within 7 days if anything changes (including expiry or cancellation of your licence).

2. Subscription and pricing

2.1 Auto-renewal

Your subscription renews automatically at the end of each monthly period unless cancelled by you or us. The card on file will be charged on the renewal date.

2.2 Promo codes

We may, from time to time, issue promotional codes (e.g. free-trial periods or discounts). Promo codes:

  • Are non-transferable and have no cash value
  • Are issued at our sole discretion
  • Have specific terms (expiry, maximum redemptions) communicated when issued
  • Do not affect the auto-renewal price after the promo period ends

2.3 Failed payments

If a charge fails, we will:

  1. Retry the charge in line with Stripe's standard retry schedule.
  2. Email you to update your payment method.
  3. Mark the subscription as past due.

If the charge has not succeeded 3 days after the renewal date, your published listings will display a "Subscription expired" template to the public, and search results will exclude them. You can sign in to your dashboard at any time to update the payment method and resume publication.

2.4 Refunds

Subscriptions are paid in advance. We do not provide refunds for partial months. If we are unable to provide the service due to a material technical issue caused by us that we cannot resolve within 7 days, we may at our discretion issue a pro-rata refund.

Australian Consumer Law statutory guarantees apply and are not affected by this section.

2.5 Cancellation

You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of the current billing period — your listings remain published and accessible until then.

3. Listing content

3.1 Your responsibilities

You warrant that, for each listing you submit:

  • You are authorised by the vendor or lessor to list it.
  • The information is accurate, not misleading, and complies with the Property and Stock Agents Act 2002 (NSW), the Australian Consumer Law, and any other applicable law (including underquoting prohibitions and disclosure obligations).
  • All photographs, floor plans, and video material are owned by you or are licensed to you for this purpose, and the licence is broad enough to permit display on the Site.
  • The listing does not infringe any third party's rights or contain any unlawful, defamatory, misleading, or offensive content.

3.2 Licence to us

By submitting a listing, you grant us a non-exclusive, royalty-free, worldwide licence to host, display, reproduce, format, and distribute the listing content for the purpose of operating the Site, including in search results, on suburb hub pages, in social-media sharing previews, and in alert emails to subscribers. The licence terminates when the listing is permanently removed from the Site (soft-deletion via the dashboard).

You retain ownership of your listing content.

3.3 Our right to remove or edit

We may, at our discretion and at any time:

  • Edit the formatting, typography, or layout of a listing to maintain consistency with the Site's brand.
  • Refuse to publish, edit, or remove a listing that we reasonably believe breaches these terms, the law, or our community standards.
  • Remove or hide a listing in response to a report from a viewer.

Where we remove a listing we will, where reasonable, give you notice and an opportunity to correct it.

4. Acceptable use

You agree not to:

  • Submit listings for properties you are not authorised to list.
  • Submit duplicate listings for the same property.
  • Use misleading photography (e.g. wide-angle distortion that misrepresents room size, AI-generated images presented as photographs, or images of a different property).
  • Underquote — the advertised price must comply with the Property, Stock and Business Agents Regulation 2014 (NSW).
  • Place external links, promotional material, or contact details inside listing photographs or descriptions for purposes unrelated to the property.
  • Use the platform to engage in any pricing collusion or other anti-competitive conduct.
  • Scrape, harvest, or republish listings from other agents on the Site.

Breach of this section may result in immediate suspension of your account.

5. Verified Agent badge

The "Verified Agent" badge is displayed where we have verified your licence number against the NSW Fair Trading public register. We may remove the badge at any time without notice if we discover the licence has lapsed, been suspended, or been cancelled. You must notify us within 7 days if your licence status changes.

6. Reports and takedowns

Viewers may report a listing through the Site. We will review reports promptly and may, at our discretion:

  • Dismiss the report.
  • Contact you for clarification.
  • Temporarily suspend the listing pending investigation.
  • Permanently remove the listing.

We will keep you informed of the outcome where reasonable.

7. Confidentiality

Both parties may receive information that is confidential to the other (including buyer enquiries received through the Site). Each party agrees to keep that information confidential, use it only for the purpose for which it was disclosed, and protect it with at least the same standard of care it applies to its own confidential information.

8. Privacy

You are a "data recipient" for personal information forwarded to you when a buyer makes an enquiry. You agree to handle that personal information in accordance with the Australian Privacy Principles, regardless of whether you would otherwise be a "small business operator" exempt from the Privacy Act 1988 (Cth).

9. Limitation of liability

To the maximum extent permitted by law:

  • Our aggregate liability to you for any claim arising out of or in connection with these terms, the Site, or your subscription is limited to the subscription fees you have paid us in the 12 months preceding the event giving rise to the claim.
  • We are not liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profit, loss of commission, loss of opportunity, or loss of goodwill.

Nothing in this section excludes any consumer guarantee under the Australian Consumer Law that cannot lawfully be excluded.

10. Indemnity

You agree to indemnify us against any loss, damage, claim, or expense (including reasonable legal costs) arising from:

  • Your breach of these terms.
  • Any listing you submit that is inaccurate, misleading, infringes a third party's rights, or breaches the law.
  • Any claim by a buyer, vendor, or other third party arising out of conduct of yours in connection with a listing.

11. Termination

We may suspend or terminate your account immediately if:

  • You materially breach these terms.
  • Your real-estate licence is suspended, cancelled, or expires.
  • You become insolvent, enter administration, or are otherwise unable to pay your debts.
  • We are required to by law or by a direction from a regulator.

On termination:

  • Your published listings will be hidden from search results.
  • We will retain listing data and audit logs for the periods set out in the privacy policy.
  • No refund of pre-paid fees is payable except where required by law.

Clauses that by their nature should survive termination will survive (intellectual property, confidentiality, privacy, limitation of liability, indemnity, governing law).

12. Changes

We may update these terms from time to time. Material changes will be notified to you by email at least 30 days before they take effect. If you do not agree to the change you may cancel your subscription before it takes effect.

13. Governing law and dispute resolution

These terms are governed by the laws of New South Wales, Australia. Any dispute must first be raised in good faith with the other party, with at least 14 days for the parties to attempt resolution. If unresolved, either party may submit the dispute to the non-exclusive jurisdiction of the courts of New South Wales.
